Throw in some gun bans, and this will actually make his administration LESS constitutional than Bush's. The downward spiral continues.

I don't think Walker will allow them to appeal it.

In any case that does suck.

Wait, this is weird

http://thecaucus.blogs.nytimes.com/2009/01/22/obama-picks-critic-of-warrantless-wiretapping-for-slot-at-justice-dept/

Why would you try to uphold warrentless wiretapping and then appoint someone who was against it?

Blair said he hoped to rebuild trust in the nation's intelligence agencies. These agencies "must respect the privacy and civil liberties of the American people, and they must adhere to the rule of law," he said. As director of national intelligence, Blair will oversee the CIA, National Security Agency and other assorted intelligence units.

That wasn't his stance until recently. It not the typical democratic party stance on the issue either.

Perhaps they want to keep it, but have someone use it who really doesn't want to? I guess it would result is a very light-handed usage, as opposed to, say, Ashcroft, who just went buck wild with it.

Like Lucius Fox with the cell-sonar computer in The Dark Knight!

As much as it scares the hell out of me I do have to admit it is useful in finding the real bad guys not just spying on the rest of us.

Right. I'm willing to accept many dangerous things in this world, as long as they are used responsibly. It's the core of libertarianism.

http://www.washingtonpost.com/wp-dyn/content/article/2008/09/13/AR2008091302284.html

Long article and it's got no real ending but it gives some insight into the clear disregard for the constitution the last administration had.

Quote:
What Addington wrote for Bush that day was more transcendent than that. He drew up new language in which the president relied on his own authority to certify the program as lawful. Bush expressly overrode the Justice Department and any act of Congress or judicial decision that purported to constrain his power as commander in chief. Only Richard M. Nixon, in an interview after leaving the White House in disgrace, claimed authority so nearly unlimited [16].

Edit: Second half

Sometimes I think that removing term limits might keep presidents from just going hog wild in their second term.

Though he probably did this in his first, too.

The events of that article took place as Bush was running against Kerry for his second term.

I think as soon as he saw that Kerry was his opponent, he just gave up on trying.

The article is kind of long but the gist of it is that Cheney kept Bush and everyone else out of the loop, going so far that Bush believed the Justice Department had brought up the legal issues at the last minute not the months before when they had actually done so. And we almost had the top 5 layers of the DoJ resign until Bush actually got the full story the day it was about to happen and he back peddled once he found out.

The dopey cowboy President was less at fault than the evil genius VP? Shocking.

But yeah, really, not a surprise at all to learn he was pulling the strings. Good bet he'll get away with it, too.
